Snake River

Update: In June 2020, the Nez Perce General Council passed a resolution recognizing the rights of the Snake River (available here).

Earth Law Center is working with Nimiipuu Protecting the Environment and others to recognize the Snake River as a subject of rights. The Snake River has long been vital to the culture and well-being of the Nez Perce and other tribes. But now the River and its people are suffering.

Salmon once spawned by the millions here, but now widespread damming and other degradation threatens their very existence. This also impacts humans, and particularly the Native Americans who rely upon a thriving Snake River for nourishment, spiritual rejuvenation and a range of activities.

To address these threats, ELC is serving as the legal experts in support of giving legal rights to the Snake River based upon concepts of tribal sovereignty, indigenous rights and the rights of nature, among others.

Why give rights to the Snake River?

  • Honors the deep relationship of tribes with the River and the River’s ecosystem

  • Another tool to help address the excessive damming of the River and other causes of ecosystem degradation

  • Can strengthen tribal rights such as fishing rights and honors the critical role of tribes in serving as environmental stewards
